He be awarded the Air Force Overseas Ribbon-Short Tour (AFOR- ST). 2. He be awarded the Air Force Expeditionary Service Ribbon (AFESR) (administratively corrected). _________________________________________________________________ APPLICANT CONTENDS THAT: He did not receive the AFOR-ST or the AFESR. In support of his request, the applicant provides a copy of an email, a copy of a special order, a copy of his travel voucher, and a copy of his DD Form 214, Certificate of Release or Discharge from Active Duty. His complete submission, with attachments, with Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: Applicant enlisted in the Regular Air Force on 29 March 2000. He was progressively promoted to the grade of senior airman (E-4), having assumed that grade effective and with a date of rank of 29 March 2003. He served on active duty for 4 years and 2 months. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denying award of the AFOR-ST. DPSIDR states they were unable to verify the applicant as being eligible for the AFOR-ST. DPSIDR notes the AFSOR-ST is not authorized for Germany. The DPSIDR evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 7 August 2009 for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with regard to the applicant’s request for award of the AFOR-ST. However, we note the Air Force office of primary responsibility (OPR) has agreed to administratively correct the applicant’s record to reflect award of the AFESR. Although the applicant provided documentation in support of his request for the award of the AFOR-ST, we find it insufficient to overcome the rationale of the Air Force OPR. Therefore, we agree with the opinion and recommendation of the office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond already granted administratively is not warranted.
